S A N J 0 A Q I I I Irl Environmental Health Department <br /> CCUN r <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> LOPEZ&LOPEZ AUTO REPAIR 2312 E WEBER AVE, STOCKTON May 11, 2021 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection for used oil and used antifreeze, including the following used oil consolidated manifest <br /> receipts: <br /> -275 gallons of used oil shipped on 8/28/2020. <br /> -250 gallons of used oil shipped on 5/17/2019. <br /> -250 gallons of used oil shipped on 10/16/2018. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years,from 5/11/2018 through <br /> 5/11/2021,for all hazardous waste including used oil and used antifreeze. Immediately locate a copy of all <br /> consolidated manifest receipts for all hazardous waste for the past three years. Maintain the records on-site for <br /> three years from the date of shipping and provide a copy to the San Joaquin County Environmental Health <br /> Department(EHD). If the receipts cannot be found, provide a statement to the EHD that future receipts will be <br /> maintained on-site for three years. <br /> This is a repeat violation, Class Il. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: Oil staining was observed on the ground, near the facility entrance and in front of the used oil tank, <br /> from spills that had not been cleaned up. Cristobal Lopez, owner, placed absorbent/kitty litter on the oil staining at <br /> the time of inspection. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by Cristobal Lopez who stated he will <br /> sweep up the absorbent and place it in a closed container for re-use on other possible oil spills.
