October 3, 1990
E
E
COUNTY OF SAN JOAQUIN
DEPARTMENT OF PUBLIC WORKS
P. O. BOX 1810 - 1810 E. HAZELTON AVENUE
STOCKTON, CALIFORNIA 95201
(209) 468-3000
Mr. Ed Padilla
Senior Environmental Health Specialist
Environmental Health Division
Public Health Services
P.O. Box 2009
Stockton, CA 95201
SUBJECT: NORTH COUNTY LANDFILL CONFORMANCE TO COSWMP
Dear Mr. Padilla:
EUGENE DELUCCHI
CHIEF DEPUTY DIRECTOR
THOMASR. FLINN
DEPUTY DIRECTOR
MANUEL LOPEZ
DEPUTY DIRECTOR
RICHARD C. PAYNE
DEPUTY DIRECTOR
The following information is being supplied to assist you in the
review of the North County Sanitary Landfill permit application as
it pertains to conformance to the County's Solid Waste Management
Plan (COSWMP).
As you know, the laws which provided for the preparation, review,
revision, and finding of conformance to COSWMPs were repealed as
of January 1, 1990, by Assembly Bill 939. When the law existed,
it required that the lead agency (Public Works in San Joaquin
County) responsible for maintaining the COSWMP to make a finding
of conformance to the COSWMP for any new or expanded facilities.
The COSWMPs were required to be reviewed every three years, and
revised when necessary. There were no expiration dates for
COSWMPs. Once approved by the California Waste Management Board
(Board), they continued to be in effect until revised. Even when
the law was repealed on January 1, 1990, they continued to be in
affect as local plans.
FINDING OF CONFORMANCE
As mentioned above, the law that required a finding of conformance
to the COSWMP was repealed. This created a period of time from
January 1, 1990 until the new Countywide Integrated
Waste Management Plans become effective which is referred to as
the "Gap". During the Gap, there was no requirement of finding of
conformance by the lead agency.
