Legal Requirements <br /> The required tasks and associated compliance dates described in MRP Order No. <br /> R5-2019-0806 are in effect and enforceable pursuant to Water Code section 13267. As <br /> stated in the MRP Order, groundwater monitoring activities shall continue until the <br /> Assistant Executive Officer determines that cleanup objectives have been <br /> accomplished, a party currently unnamed in the MRP Order is deemed responsible for <br /> the PCE release(s), or the MRP Order is rescinded in writing or otherwise amended. <br /> III. Evidence/Violations <br /> The 7 June 2022 Central Valley Water Board staff letter requested, in addition to further <br /> Site assessment, resumption of quarterly monitoring sampling and submission of <br /> corresponding electronic data report by 1 August 2022. The 15 July 2022 email <br /> correspondence from Environmental Engineering, Consulting & Remediation, Inc. (E2C; <br /> the consultant hired by the Responsible Party) stated it would inform Central Valley <br /> Water Board staff at least 48 hours in advance of the next groundwater monitoring <br /> sampling event. Subsequently, no quarterly groundwater monitoring was conducted, <br /> and quarterly data reports have not been submitted. <br /> The 9 January 2024 Central Valley Water Board staff letter reiterated the absence of <br /> groundwater monitoring in accordance with the MRP Order. A 9 January 2024 email <br /> from E2C indicated, "In our files I found a 4th Quarter 2021 Quarterly Monitoring Report <br /> and a GeoTracker upload "Success"form for this report. I can send them to you if you'd <br /> like. I also found groundwater monitoring forms and laboratory analytical data for the <br /> 2nd and 4th Quarters of 2022 as well as the 3rd Quarter 2023. 1 did not find completed <br /> reports for these data." <br /> On 10 January 2024, Central Valley Water Board staff responded to the E2C 9 January <br /> 2024 email and stated that the most recent groundwater monitoring data submitted to <br /> GeoTracker is the third quarter 2021 sampling event (received on 21 February 2021). <br /> Board staff additionally stated that any monitoring conducted after the third quarter 2021 <br /> could be presented in a single report with geo-well data and analytical laboratory data <br /> being uploaded to GeoTracker. Central Valley Water Board staff sent an additional <br /> email correspondence dated 27 February 2024 to Responsible Party and E2C asking <br /> for the status of the required monitoring. This email requested a response on the status <br /> of reports by 8 March 2024. Board staff have not received any evidence of the required <br /> groundwater monitoring post third quarter 2021 or any groundwater monitoring reports <br /> required in the MRP Order. <br />
