early May of 1993, supplied with water by a well located on <br />the rremises. On that date, and at thr time Defendant <br />Marlowe received a Notice from the San Joaquin County Public <br />14ealth Services regarding the contaminati on of tho water <br />surtiliod <br /> <br />to. Plaintiff by the well. This roncamination <br />included, but is not limited to: 1. 1-Dich1oroethane 69 <br /> <br />7 oer billion (PPb) [Maximum Contaminant Level (MCL) is 5 rpbj: <br /> <br />8 <br />1, 2-Dichloroethane 1 orb, MCL .5 Pub; 1, 1-Dichlororethylene <br /> <br />9 <br /> <br />230 PPb, MCL 6 ppb; Trichloroethylene 12 °ph, MCL 6 prb. <br /> <br />10 <br /> 9. Plaintiff is ignorant of the ex Act length of time <br /> <br />'11 <br /> said contaminants were contained in the well water surrlYing <br />12 his business, prior to April 1993, however, Plaintiff is <br /> <br />13 <br /> informed and believes, and thereon alleges that said contami- <br /> <br />14 <br /> nants were Present prinr to November of 1991. <br /> <br />15 <br /> 10. Plaintiff further alleges that he hAS ingested water <br />1 <br />2 <br />3 <br />4 <br />6 par t <br />16 <br /> from the well in various forms (Ice, in coffee and as drinking <br />17 water) on a continual basis for the entire time he has; <br />18 <br /> <br /> occuPied the premises as a tenant, lip to and including the <br />months of April 1993 (aPoroximately 25 YeRrs). <br />11.
