The following is an itemized list of hazardous materials violations that have not been <br />addressed for SHELLPRO INC as of August 24, 2021. <br />Open violations from September 29, 2020 inspection <br />Violation #7 - Failed to electronically submit an adequate ER procedures for a release or threatened release. <br />The emergency response procedures have not been submitted annually since 2017. A business plan shall include <br />the following emergency response procedures for a release or threatened release of hazardous materials, including, <br />but not limited to, the following: <br />- Immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br />- Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br />- Evacuation plans and procedures, including immediate notice, for the site <br />Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the <br />correct or updated information, and submit to the EHD for approval. <br />❑ This violation was corrected ❑ This violation will be corrected by (date): <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: <br />Violation #8 - Failed to establish and electronically submit a reasonable or an adequate training program. <br />A training program has not been submitted annually since 2017. Training programs for all employees and annual <br />training, including refresher courses, shall include familiarity with the facility's Emergency response plans and <br />procedures in the event of a release or threatened release of a hazardous material. Training shall cover, but not <br />limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />These training programs may take into consideration of each employee. Immediately prepare or update the facility's <br />training program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br />upload the correct or updated information, and submit to the EHD for approval. <br />❑ This violation was corrected ❑ This violation will be corrected by (date): <br />❑ Supporting documents included <br />Describe actions taken or will be taken to correct violation: <br />Violation #9 - Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br />System (CERS) annually for 2018, 2019, and 2020, and the business plan was submitted after January 15th for <br />2017. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be <br />submitted beginning November 1 of the previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, <br />enter the correct or updated information, and submit to the EHD for approval. <br />Page 2 of 3 <br />
