58. The developer shall build the required drainage system and water quality basins as required by <br /> MHCSD to accommodate runoff from the project. <br /> 59. Water Quality Basins Mosquito Abatement: Plans for the implementation and maintenance of the <br /> water quality basins and any other storm drainage facilities involving open bodiesof water shall be <br /> reviewed and approved by the MHCSD and if required by the Mosquito Abatement District. <br /> 60. All non-residential (Le. Office, Industrial, Commercial, etc), uses must enter into an NPDES storm <br /> water agreement with MHCSD. <br /> 61. UTILITIES <br /> A. The Developers and contractors shall comply with Ordinance No. 4162"Street Opening and <br /> Pavement Restoration Regulations". <br /> B. When any portion of an arterial street is to be included in a development's construction plans, <br /> then all of the buried utilities that are ultimately planned to be within the improvement area <br /> shall be installed as part of the street improvement project, regardless of any of the utilities <br /> needed for any phase of the development associated with the street construction. Conduits <br /> or sleeves may be installed in lieu of the buried utility, if approved by the MHCSD Public <br /> Works Director. <br /> C. Any phased development shall install all "in-tract"utilities needed to serve its development. In <br /> addition, if any future adjacent or nearby phases of the development, or adjacent <br /> Neighborhoods, will depend on obtaining service from such utilities,then the utility lines shall <br /> be sized to serve these future developments. Any utility lines that are intended to be used by <br /> an adjacent development or Neighborhood shall be installed up to the phase or Tentative Map <br /> boundary line to make it available for future extension. To recoup all or a portion of any over <br /> sizing costs, the developer may request the MHCSD to process a reimbursement agreement <br /> pursuant to the MARA. A Water Volume and Pressure Analysis shall be approved by the <br /> MHCSD for any phasing of the water system that is not served by completed portions of the <br /> Water Master Plan. If sufficient parameters are not met,then additional portions of the Water <br /> Master Plan may have to be completed, as determined by the MHCSD Public Works Director. <br /> D. When public utilities are to be located outside public rights-of-way but within the Tentative <br /> Map boundary, the developer shall provide public utility easements for these utilities. The <br /> easements shall be shown on all Final Maps and parcel maps. Prior to the submittal of <br /> improvement plans for the development,the developer shall submit to the MHCSD composite <br /> to-scale schematic plans for in-tract and outside the tract all storm drains, sanitary sewers, <br /> and water distribution facilities, both in plan and profile Any discovered conflicts shall be <br /> corrected prior to plan approval. <br /> E. Electrical transformers within residential Neighborhoods shall be in underground vaults, <br /> subject to MHCSD and Modesto Irrigation District (MID) requirements. The developer shall <br /> pay for any incremental costs relating to undergrounding transformers not paid for by MID. <br /> F. Transformers located in the downtown area, commercial and industrial areas may be placed <br /> above ground provided they are aesthetically designed and/or shielded by landscaping <br /> subject to MHCSD and MID requirements. <br /> G. The developer shall fund, design and construct the required storm drainage system in <br /> accordance with the requirements of the Storm Water Master Plan Update and the MHCSD's <br /> Standards and Specifications to serve the Tracts, unless otherwise required or approved by <br /> the MHCSD General Manager. <br /> H. The applicant shall purchase, install and maintain catch basin filters and/or other source <br /> PA-1000266—Conditions of Approval 15 <br />
