Environmental Health Department <br />AMENDED <br />11/19/2021 <br />Aboveground Petroleum Storage Act Inspection Report <br />Date: <br />June 28, 2021 <br /> Facility Address: <br /> 7501 W ELEVENTH ST, Tracy <br /> Facility Name: <br /> Eleventh Street Chevron <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 716 CFR 112.8(c)(8)(v) Failed to regularly test liquid level sensing devices to ensure proper operation. <br />OBSERVATION: Testing of the liquid level sensing devices was not discussed in the SPCC Plan. <br />REGULATION GUIDANCE: (c)(8)(v) You must regularly test liquid level sensing devices to ensure proper <br />operation. <br />CORRECTIVE ACTION: Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be <br />regularly tested to ensure proper operation. Immediately ensure the SPCC Plan completely discusses testing of <br />liquid level sensing devices and submit proof to the EHD. <br />This is a repeat violation, Class II. <br /> 719 CFR 112.8(c)(11) Failed to locate properly or provide sufficient secondary containment for mobile/portable <br />containers. <br />OBSERVATION: The following containers were observed without secondary containment: <br />- one black and red metal 55-gallon drum of oil outside of the trash containment area <br />- one black metal 55-gallon drum of oil inside of the trash containment area <br />The following containers were observed without adequate secondary containment: <br />- four black metal 55-gallon drums of new oil were observed on a red spill pallet that would not hold 55-gallons or <br />more <br />REGULATION GUIDANCE: (c)(11) Position or locate mobile or portable oil storage containers to prevent a <br />discharge as described in § 112.1(b). Except for mobile refuelers and other non-transportation-related tank trucks, <br />you must furnish a secondary means of containment, such as a dike or catchment basin, sufficient to contain the <br />capacity of the largest single compartment or container with sufficient freeboard to contain precipitation. <br />CORRECTIVE ACTION: Provide adequate secondary containment for mobile or portable oil storage tanks. Provide <br />proof or correction to the EHD. <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />An inspection report was provided to the facility operator on the day of inspection. The report was amended <br />and replaces the initial report. Violation #4010 was changed to #302.
