The products must only be used outdoors for control of burrowing pests, and are for use only on agricultural areas, orchards, non -crop areas (such as pasture and rangeland), golf courses, athletic fields, parks and recreational areas, cemeteries, airports, rights-of-way, earthen dams, and other non-residential institutional or industrial sites. 3. Products must not be applied in a burrow system that is within 100 feet of a building that is or may be occupied by people or domestic animals. This buffer zone for treatment around non-residential buildings that could be occupied by people or animals has been increased from 15 feet to 100 feet. 4. When this product is used in athletic fields or parks, the applicator must post a sign at entrances to the treated site containing the signal word DANGER/PELIGRO, skull and crossbones, the words: DO NOT ENTER/NO ENTRE, FIELD NOT FOR USE, the name and EPA registration number of the fumigant, and a 24-hour emergency response number. Signs may be removed 2 days after the final treatment. 5. When this product is used out-of-doors in a site frequented by people, other than an athletic field or park, the applicator shall post a sign at the application site containing the signal word DANGER/PELIGRO, skull and crossbones, the name and EPA registration number of the fumigant, and a 24-hour emergency response number. Signs may be removed 2 days after the final treatment. 6. Fumigant Management Plans must be written before all applications of phosphine products, including all burrowing pest fumigations. A Fumigant Management Plan is a written description of the steps designed to plan for a safe, legal and effective fumigation. The certified applicator and owner of the property to be fumigated must characterize the area to be treated and include all safety requirements in the plan before application. W Tree Hole Fumigation CONDITION W Tree Hole Fumigation In addition to labeling and California regulation requirements, these conditions apply in San Joaquin Co. A. For All Tree Hole Fumigations: 1. Notice of Intent: Required 48 hours before the start of the application. Waiver of the 48 hours must be requested and confirmed by the Commissioner before the start of the application. 2. Minimum buffer zone distance of 25 feet. 3. Certified Applicator Training Qualified Applicator Licensees (QAL) and Qualified Applicator Certificates (QAC) with subcategory "O" meet the labeled training requirement for Certified Applicators in charge of fumigations. If the QAC or QAL does not have subcategory "O" then training may be provided by the fumigant registrant (specific to active ingredient) and/or available online at www.epa.gov/fumiganttraining. Training must be renewed every 3 years and recorded on the Fumigation Management Plan prior to fumigant use. A Private Applicator Certificate does NOT meet this requirement and must complete the registrant training prior to fumigant use. 4. Fumigant Safe Handling Information Fumigant Safe Handling Information is required for all handlers involved in fumigation, in a manner that the handler can understand, and must be renewed every 12 months. Safe handling information includes: respiratory protection, signs and symptoms of exposure and emergency preparedness. The Certified Applicator must confirm handlers have received the Fumigant Safe Handling Information. Fumigant Safe Handling Information can be found where the fumigant product is purchased or at www2.epa.gov/soil-fumigants/safety-information-fumigant-handlers. 5. Fumigant Management Plan (FMP) A complete FMP must be available for review at the application site at the start of the fumigation. B. Chloropicrin 100% and in Combination with Other Products 1. If the pesticide label or regulation requires a larger buffer area, the larger buffer shall apply. There will be no waiver of the required 24 hour Notice of Intent.
