Box 2009 <br /> Stockton, CA 95201 <br /> Dear Mr. Kaufman: <br /> This is in response to your letter dated December 16, 1991, <br /> addressed to the California Integrated Waste Management Board <br /> (CIWMB) concerning Section 42170 (c) of Assembly Bill 1760 <br /> (Easton) . According to your interpretation of this section, a <br /> permit revision to include a general recycling separation program <br /> at the North County Landfill would not be required. <br /> I have conferred with our legal staff to obtain interpretation of <br /> Public Resource Code (PRC) section 42170(c) and more <br /> specifically, to address the issue raised in your letter. <br /> The intent of Chapter 3 .5 Metallic Discards, as outlined in the <br /> Legislative Counsel 's Digest, is to prohibit, after January 1, <br /> 1994, landfills from accepting any major appliance, vehicle, or <br /> other metallic discard, as defined, which contains enough metal <br /> to be economically feasible to salvage. The goal of this chapter <br /> is to require the removal, reuse or recycling of these narrowly <br /> defined items from the waste stream. To facilitate this goal, PRC <br /> 42170 (c) provides that "any solid waste facility operator who <br /> salvages major appliances, vehicles, other metallic discards or <br /> other recyclables shall not be required to revise the solid waste <br /> facilities permit to implement these activities. " <br /> As defined in PRC 42162 , "Salvagell means the controlled removal <br /> of metallic discards from the solid waste stream at a permitted <br /> solid waste facility for the expressed purpose of recycling or <br /> reuse. The narrow definition of the term "salvage" when used in <br /> PRC 42170(c) limits the meaning of the term, "other recyclables", <br /> to those metallic discards as defined. Therefore, the term <br /> "other recyclables" cannot by definition include glass, aluminum <br /> cans, wood, etc. <br /> Printed on Recycled Paper-- <br />
