Box 2009
Stockton, CA 95201
Dear Mr. Kaufman:
This is in response to your letter dated December 16, 1991,
addressed to the California Integrated Waste Management Board
(CIWMB) concerning Section 42170 (c) of Assembly Bill 1760
(Easton) . According to your interpretation of this section, a
permit revision to include a general recycling separation program
at the North County Landfill would not be required.
I have conferred with our legal staff to obtain interpretation of
Public Resource Code (PRC) section 42170(c) and more
specifically, to address the issue raised in your letter.
The intent of Chapter 3 .5 Metallic Discards, as outlined in the
Legislative Counsel 's Digest, is to prohibit, after January 1,
1994, landfills from accepting any major appliance, vehicle, or
other metallic discard, as defined, which contains enough metal
to be economically feasible to salvage. The goal of this chapter
is to require the removal, reuse or recycling of these narrowly
defined items from the waste stream. To facilitate this goal, PRC
42170 (c) provides that "any solid waste facility operator who
salvages major appliances, vehicles, other metallic discards or
other recyclables shall not be required to revise the solid waste
facilities permit to implement these activities. "
As defined in PRC 42162 , "Salvagell means the controlled removal
of metallic discards from the solid waste stream at a permitted
solid waste facility for the expressed purpose of recycling or
reuse. The narrow definition of the term "salvage" when used in
PRC 42170(c) limits the meaning of the term, "other recyclables",
to those metallic discards as defined. Therefore, the term
"other recyclables" cannot by definition include glass, aluminum
cans, wood, etc.
Printed on Recycled Paper--
