OBSERVATION: Employee training records have not been provided. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. This is a repeat violation, Class ll. 12 HSC 25505(c) Failed to have the HMBP readily available to facility or EHD personnel. OBSERVATION: Employees do not have access to the Emergency Response Plan and the inventory information on-site. REGULATION GUIDANCE: The emergency response plans and procedures, the inventory of information required by this article, and the site map required by this section shall be readily available to personnel of the business or the unified program facility with responsibilities for emergency response or training pursuant to this section. CORRECTIVE ACTION: Immediately make arrangements to have the business plan readily available for review. This is a Class II violation. Overall Inspection Comments: An inspection report was provided to the facility operator on July 19, 2021. Later the same day, the report was amended by the EHD. This amended report replaces the initial report. The report was amended to add violation 12 and to remove "Consent For: Inspection and Photos and Consent Given By: Juan Martinez, Lead Cook" information and change it to "Not Applicable". Conducted in-office Hazardous Materials Business Plans (HMBP) inspection. The food inspector, Stephanie Ramirez, performed an on-site inspection for the CO2 tank on January 27, 2021. There were 8 violations during the in-office inspection.
