Goulart : <br /> SJCOG , Inc . has reviewed the project referral for the PA-2100126 ( UP , Pre -App ) . This project was previously submitted <br /> as a Pre -Application , and a Full Application has now been submitted . Use Permit application for Cannabis Cultivation . <br /> The project is proposed to be constructed in 2 phases over 3 years . Phase 1 , with permits to be obtained within 18 <br /> months , includes the construction of a 10 , 368 square foot greenhouse for cannabis cultivation , and conversion of an <br /> existing 2 , 280 square foot home to a security office . Phase 2 , with permits to be obtained within 3 years , includes the <br /> construction of a 13 , 824 square foot greenhouse for cannabis cultivation ; the construct of a 5 , 760 square foot greenhouse <br /> for cannabis cultivation ; the conversion of an existing 5 , 000 square foot warehouse for cannabis storage ; and the <br /> conversion of an existing 1 , 440 square foot building for cannabis storage . The project site is located on the west side of <br /> S . Bird Road , 2 , 631 feet south of W. Lovely Road , Tracy (APN /Address : 250 - 100 - 06/24707 S . Bird Road , Tracy ) . <br /> The project description identifies CANNABIS as a part of the project . Cannabis is an illegal controlled substance under <br /> federal law ( Title 21 USC Controlled Substances Act ; https : //www . deadiversion . usdoi . gov/21cfr/ 21usc/ ) . The SJMSCP <br /> operates pursuant to a state and federal take permit . The federal permit was issued by the USFWS ( a federal lead <br /> agency ) , and the federally issued permit CANNOT provide take coverage for the project impacts because the project <br /> includes activities that are illegal under federal law .
