The Parties wish to avoid the expense of litigation and to ensure prompt <br />compliance with California requirements regarding hazardous materials. <br />5. Jurisdiction over this matter exists pursuant to HSC § 25404.1.1. <br />6. Respondents waive any right to a hearing in this matter. <br />7. This Consent Order shall constitute full settlement of all violations of <br />Chapter 6.95 of the California Health and Safety Code pertaining to the Site <br />and arising before the Effective Date of this Consent Order. This Consent <br />Order does not limit the CUPA from taking appropriate enforcement action <br />concerning any other violations. <br />8. Respondents admit the violations described above. <br />SCHEDULE FOR COMPLIANCE <br />9. The violations have been corrected as of August 6, 2021. <br />PAYMENTS <br />10. Respondents shall pay the CUPA $9,243.00 of which $7,875.00 is a penalty <br />and $1,368.00 is reimbursement of the CUPA's costs, through the effective <br />date. Respondents shall make an initial payment of $1,368.00 by <br />September 20, 2021. Subsequent payments of $1,575.00 shall be due by <br />October 20, 2021, November 22, 2021, December 22, 2021, January 24, <br />2022 and February 24, 2022, for a total of $9,243.00. <br />11. Respondent's checks shall be made payable to "San Joaquin County <br />Environmental Health Department," and shall be delivered together with the <br />attached Payment Voucher to: <br />San Joaquin County Environmental Health Department <br />Certified Unified Program CUPA <br />1868 E. Hazelton Avenue <br />Stockton, California 95205 <br />12. A photocopy of the check shall be sent to the following CUPA personnel <br />assigned to this matter, Michelle Henry, San Joaquin County EHD. <br />CONSENT ORDER <br />-3- <br />Duque Brothers Inc. <br />
