OBSERVATION: The training program has not been annually certified/submitted as a part of the business plan. <br /> The training program was not submitted for 2017, 2018, 2019, 2020, and 2021. The training program has not been <br /> submitted to date. <br /> REGULATION GUIDANCE: Per H&SC 25508.2, the business owner/operator shall annually review and certify that <br /> the business plan is complete, accurate, up-to-date and in compliance with Section 11022 of Title 42 of the United <br /> States Code. An annual electronic submittal satisfies these requirements. The annual business plan shall be <br /> submitted/certified by January 15 of each calendar year and may be submitted beginning November 1 of the <br /> previous year. <br /> CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, review and submit/certify the <br /> current information. <br /> .................................................................................................................................. <br /> 2. OBSERVATION: An Employee Training Plan has not been submitted; employee training records were submitted <br /> in lieu of an Employee Training Plan. <br /> REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br /> shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br /> threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> These training programs may take into consideration of each employee. <br /> CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br /> Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, <br /> and submit to the EHD for approval. <br /> This was corrected on site. <br /> This is a repeat violation, Class II. <br /> FA0009996 PR0520011 SCO01 08/17/2021 <br /> EHD 19-01 Rev.9/16/2020 Page 6 of 9 Hazardous Materials Program OIR <br /> 1868 E.
