The following is an itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for OWENS-BROCKWAY GLASS CONTAINER INC as of <br /> October 04, 2016. <br /> Open violations from April 14, 2016 inspection <br /> Violation#717 - Failed to regularly test liquid level sensing devices to ensure proper operation. <br /> According to Mr. Boscacci, the existing liquid level sensing devices have not been tested for all existing tanks. Procedures <br /> and frequency of testing for these devices were not addressed in the Spill Prevention, Control, and Countermeasure (SPCC) <br /> plan. Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be regularly tested to ensure <br /> proper operation. Immediately conduct all necessary testing of liquid level sensing devices, or provide equivalence as <br /> allowed by CFR 112.7(a)(2). Submit proof of correction to the EHD. <br /> #717 RESPONSE TO THE RECEIVED RETURN TO COMPLIANCE CORRECTIVE ACTION <br /> STATEMENT(RTC): The submitted return to compliance statement didn't indicate whether or not <br /> the existing liquid level devises have been tested. Provide proof of correction to the EHD. <br /> Violation#719 - Failed to promptly correct visible discharges and/or remove accumulations of oil in diked areas. <br /> Oily staining and standing oil were noted below the used oil tanks located in the vicinity of the onsite oil water separators. <br /> Furthermore, the oil water separator, which was full of oily liquid at the time of inspection, is being used as a secondary <br /> containment for the 1,750-gallon used oil tank. Visible discharges which result in a loss of oil from a container, including but <br /> not limited to seams, gaskets, piping, pumps, valves, rivets, and bolts, must be promptly corrected. Immediately fix all leaks <br /> and clean all visible staining , and manage according to the California Code of Regulations Title 22 hazardous waste <br /> regulations. Maintain all diked areas free of all accumulations. Submit proof of correction to the EHD. <br /> #719 RESPONSE TO THE RECEIVED RETURN TO COMPLIANCE CORRECTIVE ACTION <br /> STATEMENT(RTC): The submitted return to compliance statement didn't indicate if any or all <br /> visible discharges(observed at the time of inspection)have been addressed.
