Schulte Road <br /> Tracy, CA 95376-8628 <br /> SECOND NOTIFICATION REGARDING COMPLIANCE WITH THE ABOVEGROUND <br /> PETROLEUM STORAGE ACT, OWEN-BROCKWAY GLASS CONTAINERS,DIVISION OF <br /> OWENS-ILLINOIS,INCORPORATED, SAN JOAQUIN COUNTY <br /> Our letter dated 17 July 2000 requested your compliance with the Aboveground Petroleum Storage Act <br /> (APSA). Specifically,you were required to register all aboveground petroleum storage tanks at your <br /> facility subject to the APSA and pay the appropriate fee to the State Water Resources Control Board <br /> (SWRCB). The SWRCB has not received your storage statement and fee. <br /> Our letter also asked you to develop a Spill Prevention Control and Countermeasure (SPCC) Plan <br /> for your aboveground tanks by 18 September 2000. To date, we have not received your certified SPCC <br /> Plan. <br /> By 15 December 2000, you are required to submit the SPCC Plan and proof that you have filed the <br /> storage statement and fee with the SWRCB. Any operator or owner of a tank facility who fails to <br /> comply with the provisions of the APSA may be subject to monetary penalties. <br /> If you have any questions regarding these requirements, you may contact G.
