The CIWMB would prefer to obtain your permission/authorization
to complete the investigation and avoid the litigation associated with obtaining an inspection
warrant.
Any consultants and contractors that may be used by the CIWMB to assist in the investigation are
required to maintain liability insurance with a combined single lime coverage of $1,000,000 per
occurrence. In addition, negligent acts by the State of California would give rise to a claim under
the California Tort Claims Act. We believe these measures provide adequate protection to you
from our acts during the investigation.
Two copies of a Property Access Authorization form and a stamped return envelope are enclosed.
Please sign and date one copy of the fomi and return it in the envelope by Juiyl7, 2002. The
second copy of the form is for your records. If you do not respond, by the date indicated above,
the Environmental Health Department will consider this to be a refusal of site access.
If you have any questions regarding this matter, please contact me at (209) 468-0332.
Sincerely,
a c---LL-
Robert McClellon, upervising REHS
Environmental Health Department
Cc: John Macanas, California Waste Management Board
Enclosures:
RM: cf
