The letter <br />requested the EHD provide the current status on enforcement orders issued at two sites, 39 -CR -0031 and <br />39 -CR -0033. <br />Snyders Sanitary Garbage Disposal Site (39 -CR -0031) is a site that has several owners. The original site <br />consisted of 60 acres. Currently there are four parcels known to contain waste from the Snyder dump site. <br />One of those four was subject to later dumping by Bill Lane, previous land owner. In May 2004, the <br />EHD issued a Notice and Order (N&O) 04-01 to the Environmental Filtration Trust, 23701 S. Santa Fe <br />Road, APN 249-060-12. <br />Subsequent to the issuance of N&O 04-01 the property owner changed to Virginia Beard Trust, et al. <br />During a conference call on February 5, 2008, with California Integrated Waste Management Board <br />(CIWMB) staff counsel Mr. Steve Levine, it was determined that Environmental Infiltration Trust could <br />be liable for penalties for not complying with N&O 04-01. It is the belief of the EHD that the only asset <br />the trust had was the property in question. Mr. Levine agreed that it may not be worthwhile to pursue <br />penalties at this time. <br />The EHD has re -started enforcement efforts at this property. On January 24, 2008, the EHD staff <br />conducted an Administrative Office Hearing with the current owners of the property. The hearing <br />agreement required the current owners to meet with the EHD staff to walk the site and discuss the <br />outstanding compliance issues by February 15, 2008. During the meeting at the property the terms of the <br />Stipulated Agreement will be negotiated and issuance of an agreement to follow within 30 days. <br />The N&O 04-02 was issue to the Mc Anally, Helen, L£ Est., et al, 22865 South Henry Road, APN 249- <br />060-10. The property is one of the original four parcels that were impacted by the Snyders dump site. <br />Recently the property has been subject to foreclosure by Holt of California. <br />
