<br />The California Integrated Waste Management Board (CIWMB) requests access to the subject
<br />property, which you are on record owning, in order to conduct an investigation of reported illegal
<br />disposal activities, pursuant to Public Resources Code (PCR), Section 44100(a).
<br />Under PCR, Section 4410(b), this investigation may be conducted with the consent of the owner
<br />or with an inspection warrant. The CIWMB would prefer to obtain your permission/authorization
<br />to complete the investigation and avoid the litigation associated with obtaining an inspection
<br />warrant.
<br />Any consultants and contractors that may be used by the CIWMB to assist in the investigation are
<br />required to maintain liability insurance with a combined single lime coverage of $1,000,000 per
<br />occurrence. In addition, negligent acts by the State of California would give rise to a claim under
<br />the California Tort Claims Act. We believe these measures provide adequate protection to you
<br />from our acts during the investigation.
<br />Two copies of a Property Access Authorization form and a stamped return envelope are enclosed.
<br />Please sign and date one copy of the form and return it in the envelope by June 24. 2002. The
<br />second copy of the form is for your records. If you do not respond, by the date indicated above,
<br />the Environmental Health Department will consider this to be a refusal of site access.
