The following is an itemized list of hazardous materials violations that have not been <br />addressed for CIRCLE K as of October 28, 2021. <br />Open violations from August 101 2021 inspection <br />Violation #8 -Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: A training program was not submitted for 2019, 2019 and 2021. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br />shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br />threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />These training programs may take into consideration the position of each employee. <br />CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, <br />and submit to the EHD for approval. <br />❑ This violation was corrected <br />❑ Support <br />ing documents included <br />❑ This violation will be corrected by (date): <br />Describe actions taken or will be taken to correct violation: <br />Violation #9 -Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was submitted <br />late on 5/1/2019 for the year of 2019. The business pan was not submitted for the year of 2020. The business plan <br />was submitted on 3/9/2021 for the year of 2021. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />❑ This violation was corrected <br />❑ Supporting documents included <br />❑ This violation will be corrected by (date): <br />Describe actions taken or will be taken to correct violation: <br />Page 1 of 2 <br />
