The following is an itemized list of hazardous materials violations that have not been addressed for VALLEY SMOG & REPAIR as of October22 , 2021 . Open violations from August 30, 2021 inspection Violation #9 - Failed to annually review and certify that the HMBP is complete and accurate by the due date. OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date , January 15 . The business plan was last submitted on 05/09/2017 . REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION : Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15 . ❑ This violation was corrected ❑ This violation will be corrected by (date) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #11 - Failed to provide or document initial and/or refresher training to appropriate personnel . OBSERVATION There were not training records available at the time of the inspection . REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training . All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material , including , but not limited to , familiarity with the following plans and procedures : (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. ( B ) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons , property, or the environment (C) Evacuation plans and procedures , including immediate notice , for the business site . This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years .
