I personnel receive initial training and annual refresher training . This training <br /> 2 shall be documented electronically or by hard copy and shall be made <br /> 3 <br /> available for a minimum of three years . This violation was cited November <br /> 4 <br /> 14 , 2017 and was corrected July 24 , 2019 . <br /> 5 <br /> 6 3 . 8 The Respondents violated HSC 25505 (c ) failed to have the business <br /> 7 plan readily available to facility or EHD personnel . Facility could not provide <br /> 8 the Emergency Response Plan and the Chemical inventory upon request . <br /> 9 The emergency response plans and procedures , the inventory of <br /> 10 information required by this article , and the site map required by this section <br /> 11 <br /> shall be readily available to personnel of the business or the unified program <br /> 12 <br /> 13 facility with responsibilities for emergency response or training pursuant to <br /> 14 this section . This violation was cited November 14 , 2017 and was corrected <br /> 15 July 24 , 2019 . <br /> 16 4 . A dispute exists between the Parties regarding the alleged violations . <br /> 17 <br /> 18 5 . The Parties wish to avoid the expense of litigation and to ensure prompt <br /> 19 compliance with California requirements regarding hazardous materials . <br /> 20 6 . Jurisdiction over this matter exists pursuant to Health and Safety Code <br /> 21 <br /> ( HSC ) Section 25404 . 1 . 1 . <br /> 22 <br /> 23 7 . Respondents waive any right to a hearing in this matter . <br /> 24 8 . This Consent Order shall constitute full settlement of the violations <br /> 25 alleged above , but does not limit the CUPA from taking appropriate <br /> 26 <br /> enforcement action concerning other violations . <br /> 27 <br /> 28 9 .
