SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />OR as established by the Architect through use of recognized estimating methods. <br />Adjustments in construction cost, building structure, life safety or compliance with <br />accessibility requirements shall be included in a change order and approved by the <br />Division of the State Architect. <br />ARTICLE 13 MISCELLANEOUS PROVISIONS <br />§13.1 GOVERNING LAW, REVISE to read as follows: <br />The contract shall be governed by laws and codes of the jurisdiction where the project is <br />located and applicable state laws, regulations and codes. <br />§13.2 SUCCESSORS AND ASSIGNS, ADD the following paragraph: <br />§13.2.3 Contractor may not assign or delegate all or any portion of this Contract without the <br />Owner's expressed written consent, and no such consent shall be given which would <br />relieve Contractor or its surety of their responsibilities under the Contract. Contractor <br />may assign monies due him under the Contract to banks, trust companies or other <br />financial institutions provided written notice thereof is promptly delivered to Owner. <br />Assignment of monies earned by Contractor shall be subject to the same payment <br />obligations and retention as other payments made to it, and shall also be subject to any <br />liens or potential stop notice or bond claims for labor, services, materials, equipment or <br />other appliances supplied for the performance of work under this Contract. <br />§13.3 WRITTEN NOTICE, ADD the following paragraph: <br />§13.3.1 Any notice from one party to the other under the contract shall be in writing and signed <br />by the party giving such notice or by a duly authorized representative of such party. Any <br />such notice shall not be effective for any purpose whatsoever unless served in the <br />following manner, (a) if the notice is given to the Owner, be personal delivery thereof to <br />the Facility Planner or Owner's project representative, or by depositing the same in the <br />United States Postal Mail Service, enclosed in a sealed envelope, addressed to the <br />Owner or the Owner's project representative at the Owner's offices, postage prepaid and <br />registered; (b) If the notice is given to the Contractor, by personal delivery thereof to said <br />contractor or to the Contractor's duly authorized representative at the project site. Or by <br />depositing the same in the United States Postal Service, enclosed in a sealed envelope, <br />addressed to the Contractor's business address, postage prepaid and registered; and (c) <br />if the notice is given to the surety or any other person, by personal delivery to such <br />surety or other person, or by depositing same in the United States Postal Service, <br />enclosed in a sealed envelope, postage prepaid and registered. <br />§13.4 RIGHTS AND REMEDIES <br />§13.4.2 ADD the following words after, "Architect or Contractor ", "unless stated otherwise within the <br />contract documents,". <br />§13.5 TEST AND INSPECTIONS <br />§13.5.1 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />35 <br />
