SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />§15.1.6 CLAIMS FOR CONSEQUENTIAL DAMAGES <br />DELETE the words "rental expenses, for losses of use". <br />ADD the following paragraph and subparagraphs: <br />§15.1.7 CLAIMS FOR $375,000 OR LESS <br />§15.1.7.1 Claim Defined: For purposes of this section, "CLAIM" means a separate demand by the <br />Contractor of $375,000 or less for (1) a time extension, (2) payment of money or <br />damages arising from work done by or on behalf of the Contractor pursuant to the <br />contract for a public work and payment of which is not otherwise expressly provided for <br />or the claimant is not otherwise entitled to, or (c) an amount the payment of which is <br />disputed by the Owner. <br />§15.1.7.2 Claim Procedures: For any CLAIM arising under §15.1.7, the following procedures will <br />apply: <br />Filing Claims: The CLAIM must be in writing and include the documents <br />necessary to substantiate the CLAIM. CLAIMS must be submitted no later than <br />twenty (20) days after the event upon which the claim is predicated occurred. <br />Failure by Contractor to submit any claim no later than twenty (20) days after the <br />event upon which the claim is predicated occurs, shall waive Contractor's right to <br />file claim for that event." <br />2 Claims of Less than $50,000: <br />a For CLAIMS less than fifty thousand dollars ($50,000), the Owner shall <br />respond in writing to any written CLAIM within forty-five (45) days of <br />receipt of the CLAIM, or may request, in writing, within thirty (30) days of <br />receipt of the CLAIM, any additional documentation supporting the CLAIM <br />or relating to defenses or claims the Owner may have against the <br />claimant. <br />b If additional information is thereafter required, it shall be requested and <br />provided pursuant to this Section, upon mutual agreement of the Owner <br />and the claimant. <br />c The Owner's written response to the CLAIM, as further documented, shall <br />be submitted to the claimant within fifteen (15) days after receipt of the <br />further documentation or within a period of time no greater than that taken <br />by the claimant in producing the additional information, whichever is <br />greater. <br />3 Claims Between $50,000 and $375,000: <br />a For CLAIMS of over fifty thousand dollars ($50,000) and less than or <br />equal to three hundred seventy-five thousand dollars ($375,000), the <br />Owner shall respond in writing to any written CLAIM within sixty (60) days <br />44 <br />
