Environmental Health Department SANJOAQUIN <br />COUNTY <br />Greatness grows here. <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br /> <br />Responsible Party: UPS <br /> Date: Jun 16, 2021 <br />RP Mailing Address: JLWOMACK@UPS COM <br /> Record ID#: CO1VV8AF 1P <br />SPRINGBORO, OH <br />Program Element 2546 <br />Spill Location: 1000 E ROTH RD LATHROP <br /> Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />Approximately 20 gallons of 5NILL coolant spilled from a 300 gallon tote located in the shipping container EMHU-650-154. <br />The tote was damaged during transport. <br /> <br />OBSERVAllONS: <br />The San Joaquin County Environmental Health Department (EHD) was notified that a 300 gallon tote was damaged during <br />transport releasing approximately 20 gallons of 5NILL coolant. Shipping tote was located inside the intermodal container <br />EMHU-650-154 (Cal OES Spill Report: #:21-3191). Patriot Environmental was retained by the Union Pacific to facilitate <br />clean up. Based on a site visit, the shipping container and the container below it (UPHZ 166177) were impacted by the spill. <br />Small pooling of black oily like liquid was observed below both containers. Clean up is pending the arrival of additional <br />equipment. Implement all necessary clean up. Provide hazardous waste determination and spill clean up debris disposal to <br />the EHD, provide waste determination and disposition of the residual coolant located inside the 300 gallon tote.Please be <br />advised the disposal of any hazardous waste, or the causing thereof, is prohibited when the disposal is at a facility which is <br />not permitted or authorized for hazardous waste disposal. [HSC 25189.5 (a)]. All generated hazardous waste must be <br />disposed of under the appropriate waste manifesting procedure f HSC 25160 (b)(3)1. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft_ of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25/89 5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />END 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br />Page 1 of 2 <br />1868 E.
