• Used oil must be stored in tanks or contain- <br />ers in good condition. Tanks and containers must <br />be made of non -earthen, non -absorbing, rust -re- <br />sistant material such as steel or oil -resistant plastic, <br />and have adequate structural support to contain the <br />used oil. "Good condition" means no severe rust- <br />ing, no apparent structural defects or deterioration, <br />and no leaking. All tanks and containers must have <br />tight -fitting fids that are kept closed except when <br />used oil is being added or removed. Regular <br />inspections and routine maintenance of all stor- <br />age tanks and containers are required. Faulty <br />tanks and containers must be repaired or replaced. <br />• Secondary containment for storage tanks is <br />required. Secondary containment is a backup <br />containment system designed to prevent the release <br />and migration ofwastes or accumulated liquids out <br />of a storage tank or a storage tank system Examples <br />of secondary containment systems include: an im- <br />pervious barrier such as a liner, a vault, a double - <br />walled tank or an impervious bermed area. <br />• Aboveground storage tanks and containers <br />accumulating used oil, and fill pipes used to <br />transfer used oil into underground storage tanks <br />must be labeled with the words "USED OIL - <br />HAZARDOUS WASTE," the initial date of ac- <br />cumulation, and the name and address of the <br />generator. For shipping, containers must also <br />be labeled with the following: <br />• The statement: "Hazardous Waste -State <br />and Federal Law Prohibit Improper <br />posal. If found, contact the nearest police <br />or public safety authority, the U.S. Envi- <br />ronmental Protection Agency or the Cali- <br />fomia Department of Toxic Substances <br />Control_" <br />• The generator's name and address. <br />• The proper Department of Transport <br />ation <br />(DOT) shipping name and the generator's <br />identification number. <br />• The Uniform Hazardous Waste Mand <br />number. <br />The shipping identification number. <br />• Additional requirements for used oll genera- <br />tors are contained in the HSC and 22 CCR pro- <br />visions cited at the beginning of this fact sheet. <br />The Rebuttable Presumption <br />(Total Halogens Determination) <br />The Used Oil Handler is Required to Make a <br />Total Halogens Determination: <br />o ° ".Door • I Ir«:ot•� I� �w <br />Malopen• Hot lom' <br />v/LESOG <br />VNLE55: <br />oat <br />aetl Oii <br />l W <br />i wu Na <br />Mi NW wnn ftw <br />usueD w«xino oin I sday <br />LFGftefr'gaeation <br />�L 'TJ uus Lu <br />USED <br />` J <br />USED <br />OIL <br />Used oil handlers (e.g., generators, used oil col- <br />lection centers, transporters and used oil recy- <br />cling facilities) are required to determine <br />whether the total halogen content of each used <br />oil shipment exceeds 1,000 ppm halogens. Used <br />oil determined to contain more than 1,000 ppm <br />total halogens is presumed to have been mixed <br />with halogenated hazardous waste. Used oil <br />containing more than 1,000 ppm total halogens <br />must be managed as a Resource Conservation <br />and Recovery Act (RCRA) hazardous waste un- <br />less the used oil can be demonstrated not to have <br />been mixed with halogenated hazardous waste <br />(i.e., unless the presumption is rebutted).
