Am pm 83333 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. <br />- 2019 business plan submittal was submitted on time on 11/15/2018 and was complete. <br />- 2020 business plan submittal was submitted late on 10/21/2020 and was missing the hazardous materials <br />inventory and emergency response plan sections. <br />- 2021 business plan submittal was not made. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: This was corrected on site. A CERS submittal was made during the inspection. <br />This is a repeat violation, Class II. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br />OBSERVATION: Training records for the hazardous materials business plan were not observed on site during the <br />inspection. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br />receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a <br />release or threatened release of a hazardous material, including, but not limited to, familiarity with the following <br />plans and procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />CORRECTIVE ACTION: This was corrected on site. Training was provided during the inspection to employees and <br />documented on the SJC HMBP Training Records Template. <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were four violations during the <br />inspection. All violations were corrected on site during the inspection. No additional follow up is required. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($152).
