I there is a reasonable potential for a release to the environment of any hazardous substance stored in <br /> 2 the UST system, Defendants shall take all appropriate action to prevent a release, including, but not <br /> 3 limited to, shutting down the effected portion of the UST system and removing hazardous substance <br /> 4 and/or material from the UST system. <br /> 5 V. Prior to conducting any UST testing or certification required by title 23 of <br /> 6 the California Code of Regulations, Defendants shall give notice to the UPA in the form and manner <br /> 7 required by the agency. <br /> 8 W. Defendants shall give at least 48 hours' notice to the relevant UPA before <br /> 9 conducting any monitoring or testing specified in Paragraph v. <br /> 10 X. Defendants shall cause the spill containment structure testing required by <br /> 11 Health and Safety Code section 25284.2; the line tightness testing required by California Code of <br /> 12 Regulations, title 23, section 2636(0(4); the secondary containment testing required by California <br /> 13 Code of Regulations, title 23, section 2637; the testing required for UST monitoring equipment <br /> 14 certification required by California Code of Regulations, title 23, section 2638; and any monitoring <br /> 15 or testing required under California Code of Regulations, title 23, section 2643 to occur as required <br /> 16 by law. if compliance testing has been timely completed as required by law, but the corresponding <br /> 17 certifications are subsequently rejected or considered a failure by any UPA, Defendants shall either <br /> 18 promptly resolve any dispute with such UPA or cause the compliance testing to be redone. <br /> 19 Y. Defendants shall maintain on-site at their Facilities, or off-site at a readily <br /> I` 20 available location approved by the UPA, written monitoring and maintenance records and shall make <br /> 21 the records available upon the request of the UPA and/or State Water Board within 36 hours, as <br /> 22 required by California Code of Regulations,title 23, section 2712(b). <br /> 23 Z. Defendants shall report to the UPA any unauthorized release or escape of <br /> 24 a hazardous substance stored in a UST system which escaped from the secondary containment, or <br /> 25 from primary containment if no secondary containment exists, within 24 hours after the release has <br /> 26 been detected or should have been detected,as required by Health and Safety Code section 25295. <br /> 27 aa. Where the UST system, testing or certification set forth in Paragraph x <br /> 28 above indicates a failure, and where the failure would indicate to a reasonable operator that there is <br /> Hassan&Sons,Inc.,et al.IPropmedl Final Judgment and Permanent Injunction <br />
