I sections 66262.34. 2 Cee. Defendants shall clearly and visibly mark each tank or container of 3 hazardous waste generated or stored at Defendants' Facilities with the following information: (i) the 4 tank or container shall be labeled, "HAZARDOUS WASTE; (ii) the date upon which each period of 5 accumulation began; (iii) the date the applicable accumulation period began" (iv) the physical state 6 of the wastes; (v) a statement of the hazardous properties of the waste, e.g."flammable,reactive, etc.; 7 and the name and the name and address of the Facility producing the waste as required by California 8 Code of Regulations,title 22, sections 66262.34(4). 9 fff Defendants shall assure all containers holding hazardous waste are always 10 closed except when it is necessary to add or remove waste as required by California Code of 11 Regulations, title 22, sections 66262.34(d). 40 CFR §§262.34 and 265.173. 12 ggg. Defendants shall prepare and file a hazardous waste manifest, with the 13 Department of Toxic Substance Control ("DTSC") within thirty (30) days of submitting hazardous 14 waste for transportation, for all hazardous waste that is transported, or submitted for transportation, 15 to offsite handling, treatment, storage, disposal, or any combination thereof, from any Facility, as t 16 required by Health and Safety Code section 25160(6)(3)and California Code of Regulations,title 22, 17 section 66262.23. 18 hhh. Defendants shall contact the owner or operator of the hazardous treatment, 19 storage, disposal facility where hazardous waste from Defendants Facility was shipped to determine 20 the status of the hazardous waste, in the event Defendants have not received a copy of the manifest 21 signed by all transporters and the facility operator within thirty-five (35) days of the date the waste 22 was accepted by the initial transporter, as required by Health and Safety Code section 25160(b)(3) 23 and California Code of Regulations, title 22, section 66262.42. 24 iii. Defendants shall file an exception report concerning the transportation of a 25 hazardous waste to a treatment, storage, or disposal facility when the facility has failed to return any 26 executed manifest, as required by Health and Safety Code section 25160(b)(3) and California Code 27 of Regulations, title 22,section 66262.42. 28 jjj.
