SAN '�d DAQ II II Environmental Health Department <br /> C0uNT <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> CARLS JR#7193 1 1963 N TRACY BLVD,TRACY July 12, 2021 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br /> OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br /> Environmental Reporting System (CERS)annually by the due date, January 15. The business plan was submitted <br /> late on 6/9/2021 for the year of 2021.The business plan was not submitted for the years of 2018 and 2019. The <br /> business plan was submitted late for the years of 2020 and 2021. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br /> information, and submit to the EHD for approval. <br /> This violation has been corrected. <br /> This is a Class II violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> OBSERVATION: Employee training records were unavailable for review at time of inspection. <br /> REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br /> receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a <br /> release or threatened release of a hazardous material, including, but not limited to,familiarity with the following <br /> plans and procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br /> years. <br /> CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br /> training records to the EHD. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Conducted in-office Hazardous Materials Business Plans (HMBP) inspection. The food inspector, Kadeanne , <br /> performed an on-site inspection for the CO2 tank on 3/3/2021. <br /> There were 2 violations found during the in-office inspection. complete and submit a copy of the Return to <br /> Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or <br /> will be taken for each violation, and any supporting paperwork, by 8/11/2021. <br /> Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152).
