Administrative Draft Environmental Impact Report <br /> Gill Medical Center Project <br /> San Joaquin County Ordinance, Division 15, Chapter 9-1505 - Trees <br /> The intent of Division 15, Chapter 9-1505 of the Ordinance Code of San Joaquin County, California is to <br /> preserve the County's tree resources, The removal of a Native Oak Tree, Heritage Oak, or Historical Tree <br /> shall require an approved improvement plan application, as specified in Chapter 9-884 of the Title, and <br /> shall be subject to the provisions of this Chapter, unless exempted by Section 9-1505.8 or 9-1505.9. <br /> 4.6.3 Environmental Impacts and Mitigation Measures <br /> 4.6.3.1 Thresholds of Significance <br /> The following thresholds of significance are based on Appendix G of the CEQA Guidelines. For purposes <br /> of this EIR, implementation of the project would be considered to have a significant adverse impact on <br /> biological resources if it would: <br /> Have a substantial adverse effect, either directly or through habitat modifications, on any species <br /> identified as a candidate, sensitive, or special status species in local or regional plans, policies, or <br /> regulations, or by CDFW, NMFS, or USFWS, and meets the definition of Section 15380 (b), (c), or <br /> (d) of the CEQA Guidelines. <br /> Have a substantial adverse effect on any riparian habitat or other sensitive natural community <br /> identified in local or regional plans, policies, regulations or by CDFW or USFWS. <br /> Have a substantial adverse effect on federally protected wetlands, as defined by Section 404 of <br /> the CWA (including, but not limited to, marsh, vernal pool, coastal, etc.), either individually or <br /> cumulatively, through direct removal, filling, hydrological interruption, or other means. <br /> Interfere substantially with the movement of any resident or migratory fish or wildlife species or <br /> with established resident or migratory wildlife corridors or impede the use of wildlife nursery sites. <br /> Conflict with any local policies or ordinances protecting biological resources, such as a tree <br /> preservation policy or ordinance. <br /> Conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community <br /> Conservation Plan, or other approved local, regional, or state habitat conservation plan, recovery <br /> plan, or federal Biological Opinion. <br /> 4.6.3.2 Methods of Analysis <br /> For the purposes of this assessment, special-status species are defined as plants or animals that: <br /> are listed, proposed for listing, or candidates for future listing as threatened or endangered under <br /> the federal Endangered Species Act (ESA); <br /> are listed or candidates for future listing as threatened or endangered under the California ESA; <br /> meet the definitions of endangered or rare under § 15380 of the CEQA Guidelines; <br /> Biological Resources 4.6-31 October 2021 <br />
