Administrative Draft Environmental Impact Report <br /> Gill Medical Center Project <br /> made to the person responsible for the excavation, or to his or her authorized representative, in <br /> the manner provided in Section 5097.98 of the Public Resources Code. <br /> CEQA Guidelines Section 15O64.5(e) requires that excavation activities stop whenever human remains are <br /> uncovered and that the county coroner be called in to assess the remains. If the county coroner <br /> determines that the remains are those of Native Americans, the Native American Heritage Commission <br /> (NAHC) must be contacted within 24 hours.At that time, the lead agency must consult with the <br /> appropriate Native Americans, if any, as timely identified by the NAHC. Section 15064.5 directs the lead <br /> agency (or applicant), under certain circumstances,to develop an agreement with the Native Americans <br /> for the treatment and disposition of the remains. <br /> In addition to the mitigation provisions pertaining to accidental discovery of human remains, the CEQA <br /> Guidelines also require that a lead agency make provisions for the accidental discovery of historical or <br /> archaeological resources, generally. Pursuant to § 15O64.5(f), these provisions should include "an <br /> immediate evaluation of the find by a qualified archaeologist. If the find is determined to be an historical <br /> or unique archaeological resource, contingency funding and a time allotment sufficient to allow for <br /> implementation of avoidance measures or appropriate mitigation should be available. Work could <br /> continue on other parts of the building site while historical or unique archaeological resource mitigation <br /> takes place." <br /> 4.7.2.3 Local <br /> San Joaquin County General Plan Policy Document <br /> The 2035 County of San Joaquin General Plan emphasizes the importance of cultural and historic <br /> resources in the County.The County is committed to ensuring that development occurs in a manner that <br /> limits impacts to natural and cultural resources and will avoid development in areas in naturally and <br /> culturally sensitive areas whenever possible, especially in the Delta. Preserving these resources is <br /> important and their protection needs to be considered during the planning, permitting, and construction <br /> of any new development. <br /> The following policies relates to cultural resources and historic preservation: <br /> ED-5.5: Heritage Tourism. The County shall encourage programs that promote the <br /> history and culture of San Joaquin County to increase heritage tourism <br /> opportunities. <br /> NCR-6.1: Protect Historical and Cultural Resources. The County shall protect <br /> historical and cultural resources and promote expanded cultural <br /> opportunities for residents to enhance the region's quality of life and <br /> economy. <br /> NCR-6.2: No Destruction of Resources. The County shall ensure that no significant <br /> architectural, historical, archeological, or cultural resources are knowingly <br /> destroyed through County action. <br /> Biological Resources 4.7-8 October 2021 <br />
