Administrative Draft Environmental Impact Report <br /> Gill Medical Center Project <br /> contained in 26 CCR. State agencies with primary responsibility for enforcing state regulations and <br /> responding to hazardous materials transportation emergencies are the California Highway Patrol and the <br /> Caltrans.Together, these agencies determine container types, placarding, and signage used, and license <br /> hazardous waste haulers to transport hazardous waste on public roads. <br /> California has developed an emergency response plan to coordinate emergency services provided by <br /> federal, state, and local governments and private agencies. Response to hazardous materials incidents is <br /> one part of the plan.The plan is managed by Cal OES,which coordinates the responses of other agencies <br /> in the project area. <br /> Porter-Cologne Water Quality Act <br /> Through the Porter-Cologne Water Quality Act and the NPDES program,the RWQCB has authority to <br /> require proper management of hazardous materials during project construction. For a detailed description <br /> the Porter-Cologne Water Quality Act,the NPDES program, and the role of the RWQCB, see Draft EIR <br /> Section 4.12 Hydrology and Water Quality. <br /> California Occupational Safety and Health Administration <br /> The California Occupational Safety and Health Administration (Cal/OSHA) assumes primary responsibility <br /> for developing and enforcing workplace safety regulations within the state. Cal/OSHA standards are <br /> typically more stringent than federal OSHA regulations and are presented in Title 8 of the CCR. Cal/OSHA <br /> conducts on-site evaluations and issues notices of violation to enforce necessary improvements to health <br /> and safety practices. <br /> California Geologic Energy Management Division (CaIGEM) <br /> CaIGEM oversees the drilling, operation, maintenance, and plugging and abandonment of oil, natural gas <br /> and geothermal wells. The regulatory program emphasizes the wise development of oil, natural gas, and <br /> geothermal resources in the state through sound engineering practices that protect the environment, <br /> prevent pollution, and ensure public safety. Sections 3208 and 3255(a) (3) of the Public Resources Code <br /> give CaIGEM the authority to order the abandonment or re-abandonment of any well that is hazardous, or <br /> that poses a danger to life, health, or natural resources. Responsibility for abandonment and or re- <br /> abandonment costs for any well may be affected by the choices made by the local permitting agency, <br /> property owner, and/or developer. <br /> The Project site contains the "North Stockton Unit A" 1 well (API: 0407700519)which is a former gas well <br /> converted to water well. The future disposition of this well is subject to the above Public Resources Code <br /> sections and is under the authority of CaIGEM. <br /> 4.11.2.3 Local <br /> The San Joaquin County General Plan Public Health and Safety Element contains the following applicable <br /> policies pertaining to hazards and hazardous materials: <br /> PHS-1.7: Emergency Response Facilities Location The County shall ensure that <br /> emergency response facilities and other critical facilities (e.g., hospitals, <br /> Noise 4.11-3 October 2021 <br />
