FINDINGS FOR USE PERMIT
PA-2100230
PORTUGUESE CLUB/TSJ CONSULTING, INC.
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any
applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the use type Communication Services —Type II may be
conditionally permitted in the R-L (Low Density Residential) zone with an approved Use
Permit application. The project site has a General Plan designation of R/L (Low Density
Residential), and the R-L zone is an implementing zone for this designation. There are no
Master Plans, Specific Plans, or Special Purpose Plans in the vicinity.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because adequate utilities, access roads, sanitation, drainage,
and other necessary facilities have been provided and the proposed improvements are
properly related to existing and proposed streets and highways. The unmanned facility does
not require water or sewer. Storm drainage will be constructed under permit and inspection
by the Environmental Health Department and the Department of Public Works.
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the 9.88-acre parcel is of adequate size and shape to
accommodate the proposed, and existing, uses, and all yards, building coverage, setbacks,
parking areas and other requirements of the Development Title. Pursuant to regulations, the
support structure (monopole) is located a distance equal to at least the height of the said
structure from residential-structures on adjoining properties.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This finding can be made because the project has been conditioned to meet San Joaquin
County development regulations that protect public health, safety, and welfare and ensure
the project is not injurious to adjacent properties.
5. The use is compatible with adjoining land uses.
• This finding can be made because the proposed use was previously approved at this site
and extending the monopole height will not impact the compatibility of the use with
adjoining land uses.
PA-2100230—Findings 1
