Environmental Health Department <br />Aboveground Petroleum Storage Act Inspection Report <br />Date: <br />November 15, 2021 <br /> Facility Address: <br /> 15250 N THORNTON RD, Lodi <br /> Facility Name: <br /> Love's Travel Stop #538 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 715 CFR 112.8(c)(8), 25270.4.5(a) Failed to have a high level monitoring and to engineer or update containers to avoid <br />discharge. <br />OBSERVATION: The 4/2021 to present monthly inspection reports noted that the light is not functioning for the <br />overfill for the three 20,000-gallon bidiesel tanks. The SPCC Plan lists audible/visual s the method of overfill <br />prevention. <br />REGULATION GUIDANCE: (c)(8) Engineer or update each container installation in accordance with good <br />engineering practice to avoid discharges. You must provide at least one of the following devices: <br />(i) High liquid level alarms with an audible or visual signal at a constantly attended operation or surveillance station. <br />In smaller facilities, an audible air vent may suffice. <br />(ii) High liquid level pump cutoff devices set to stop the flow at a predetermined container content level. <br />(iii) Direct audible or code signal communication between the container gauger and the pumping station. <br />(iv) A fast response system for determining the liquid level of each bulk storage container such as digital computers, <br />telepulse, or direct vision gauges. If you use this alternative, a person must be present to monitor gauges and the <br />overall filling of bulk storage containers. <br />CORRECTIVE ACTION: Immediately install an approved liquid level sensing device on three 20, 000-gallon <br />biodiesel tanks in accordance with CFR 112.8 and implement necessary procedures to ensure that this device is <br />fully functional and in use at all times during tank’s filling operations, provide proof of correction to the EHD. <br />This is a repeat violation, Class II. <br /> 719 CFR 112.8(c)(11) Failed to locate properly or provide sufficient secondary containment for mobile/portable <br />containers. <br />OBSERVATION: Page 20 of the SPCC Plan states that there are no mobile storage containers onsite. Three <br />55-gallon drums of gear oil were observed inside the shop. <br />REGULATION GUIDANCE: (c)(11) Position or locate mobile or portable oil storage containers to prevent a <br />discharge as described in § 112.1(b). Except for mobile refuelers and other non-transportation-related tank trucks, <br />you must furnish a secondary means of containment, such as a dike or catchment basin, sufficient to contain the <br />capacity of the largest single compartment or container with sufficient freeboard to contain precipitation. <br />CORRECTIVE ACTION: Ensure that the SPCC Plan accurately describes the facility . Provide proof or correction to <br />the EHD. <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by 12/15/2021. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($152).
