Send a copy to the San Joaquin County Environmental Health Department(EHD). This is a Class II violation. 118 CCR 66265.16 Failed to maintain complete hazardous waste training records. OBSERVATION: The business operator could not produce documentation during the inspection that demonstrates employees have complete hazardous waste training as specified in this section. •Yulisa Galvan, Operations Manger for the hazardous materials processing area stated that the way they classify if a material is a hazardous waste is by looking at Section 14 of the Safety Data Sheets.A laminated reference sheet was also observed in the hazardous materials processing area that refers to look at Section 14 of the Safety Data Sheets. Section 14 is Transportation Information but does not classify whether a material is hazardous waste. •Two absorbent piles were observed in the fueling station. Personnel conducting the spill clean ups were not observed on site and was not clear when the absorbent would be cleaned up. One absorbent pile was driven through by a service vehicle, spreading the absorbent further. REGULATION GUIDANCE: Title 22 California Code of Regulations section 66265.16 Personnel Training CORRECTIVE ACTION: Immediately train all employees who work with hazardous waste in compliance with the time frames and training materials required by this section. Provide training documentation to the San Joaquin County Environmental Health Department(EHD)within 30 days. The documentation must include a list of training topics, date of training,job title, name of employee,written job description (qualifications and duties), and employee signed (or certified)record that documents the training. This is a Class II violation. 119 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste transported from the site in the past three years. The missing receipts include: •020403259JJK, ship date 7/31/2019-waste code 221 REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Locate a copy of the receipts listed above. Maintain the records on-site for three years from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department(EHD). If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for three years. This is a Class II violation.
