Send a copy to the San Joaquin County Environmental Health <br /> Department(EHD). <br /> This is a Class II violation. <br /> 118 CCR 66265.16 Failed to maintain complete hazardous waste training records. <br /> OBSERVATION: The business operator could not produce documentation during the inspection that demonstrates <br /> employees have complete hazardous waste training as specified in this section. <br /> •Yulisa Galvan, Operations Manger for the hazardous materials processing area stated that the way they classify if <br /> a material is a hazardous waste is by looking at Section 14 of the Safety Data Sheets.A laminated reference sheet <br /> was also observed in the hazardous materials processing area that refers to look at Section 14 of the Safety Data <br /> Sheets. Section 14 is Transportation Information but does not classify whether a material is hazardous waste. <br /> •Two absorbent piles were observed in the fueling station. Personnel conducting the spill clean ups were not <br /> observed on site and was not clear when the absorbent would be cleaned up. One absorbent pile was driven <br /> through by a service vehicle, spreading the absorbent further. <br /> REGULATION GUIDANCE: Title 22 California Code of Regulations section 66265.16 Personnel Training <br /> CORRECTIVE ACTION: Immediately train all employees who work with hazardous waste in compliance with the <br /> time frames and training materials required by this section. Provide training documentation to the San Joaquin <br /> County Environmental Health Department(EHD)within 30 days. The documentation must include a list of training <br /> topics, date of training,job title, name of employee,written job description (qualifications and duties), and employee <br /> signed (or certified)record that documents the training. <br /> This is a Class II violation. <br /> 119 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste <br /> transported from the site in the past three years. <br /> The missing receipts include: <br /> •020403259JJK, ship date 7/31/2019-waste code 221 <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Locate a copy of the receipts listed above.
