Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />December 08,2021 <br />Facility Address: <br />4242 N WILCOX RD, STOCKTON <br />Facility Name: <br />A&K RAILROAD MATERIALS INC <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR -Notice to Comply) <br />RemarksItem # <br />9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information was not reviewed and resubmitted in the California Environmental <br />Reporting System (CERS) annually by the due date, January 15 for 2019. The business plan submittal for 2021 <br />was completed on 11/9/2020. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year . <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This was corrected on site. <br />This is a Class II violation. <br />10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br />OBSERVATION: During the inspection, two 55 gallon drums (110 gallons) of pipe coating were found on site. The <br />material has been on site a number of years. The business has not updated and submitted the information within 30 <br />days. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br /> - A 100 percent or more increase in the quantity of a previously disclosed material. <br /> - Any handling of a previously undisclosed hazardous materials <br /> - A change of business address, business ownership, or business name. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This was corrected on site. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by January 7, 2022. <br />Assistance with CERS update and submittal was provided at the time of inspection. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. <br />FA0010048 PR0520044 SC001 12/08/2021 <br />EHD 19-01 Rev. 12/06/2021 Hazardous Materials Program OIRPage 3 of 4 <br />1868 E.
