8 -2 <br />Copies of available permits are p rovided in App endix A.Nat iona l and Po ll utant Discharge <br />Eli mination S',stem Permit. <br />Finding of Conformance <br />• The California Integrated Waste Management Act of 1989 (Public Resources Code <br />Section 40000. seq.) requires cities and counties to prepare a plan for their solid <br />waste system known as a Countywide Integrated Waste Management Plan <br />(CIWMP ). The County of San Joaquin has completed their CIWMP. The RRF and <br />Composting Facility is identified in the Non -Disposal Facility Element (NDFE ) as part <br />of the CIWMP. <br />California Environmental Quality Act <br />• An Environmental Impact Report (EIR ). which describes and supports the design <br />and operation of the Forward Landfill was filed with the State Clearinghouse (SCH <br />No. 2001052081) and certified by the San Joaquin County Planning Commission <br />on Februa ry 6 . 2003. Subsequently . a Notice of Determination was filed with the <br />State Clearinghouse on April 14. 2003. <br />In addition . a Negative Declaration was prepared to address environmental impacts <br />associated with the relocation of the permitted boundaries. The Negative <br />Declaration was filed with the State Clearinghouse (SCH No. 2010112045 ) and <br />certified by the San Joaquin County Planning Commission in Janua ry 2011. <br />Siting and Design Re q uirements (14 CCR . Section 17406.2) <br />The RRF's design and operation were found to be in compliance with the California <br />Code of Regulation Title 14 Minimum Standards for Solid Waste Handling and <br />Disposal as determined by a document review conducted by CalRec ycle and the <br />LEA prior to the issuance of the SWFP. <br />So Incl ude written proof of permission for encroachment on fl ood p lains or tide land s. <br />C. Identify zoning of all adjacent parcels and whethe r the site or ad j acent parcels are <br />within an Agricul t ura l Preserve. <br />Pursuant to the San Joaquin County 2010 General Plan . the land use designation for the <br />landfill is G/A (General Agricultura l) and the zoning is AG-40 (General Agricultural. 40-acre <br />minimum lot size ). The San Joaquin County Development Title specifies that Ma jor Impact <br />Services are allowed in AG-40 zone classification areas sub ject to a Use Permit. Ma jor <br />Impact Services . which include sanita rv landfills. are defined as land intensive activities that <br />must be located awa y from residences or concentrations of people due to the nature of the <br />operation's impacts. The existing Forward Landfill (including the RRF and Composting <br />Facility) is currentl y operated under San Joaquin County Land Use Permits Nos. UP-00 -7 ,and <br />PA-10000245 granted in 2003 and 2011. respectively . <br />Zon ing of the site and of adjacent parcels may be demonstrat ed with cop ies of adopted <br />loning maps or by depiction on a p lot plan . <br />In 1973, \\'hen the ori ginal Use Permit for the site was approved, the l on i ng designation for <br />the area was Exclus ive Agrieu lture (EA 10).
