F <br /> FINANCIAL ASSURANCE MECHANISM <br /> FOR TITLE 23, CHAPTER 15, ARTICLE 5 (HEREAFTER ARTICLE 5) <br /> As previously indicated, the estimated cost for a reasonably <br /> foreseeable release is approximately $630,000. <br /> The County currently owns four sanitary landfills - one that is <br /> undergoing closure and three that are active. It is highly <br /> unlikely that a release would occur simultaneously at more than one <br /> site. Therefore, the County proposes to provide a financial <br /> mechanism that would provide funding to cover remediation costs for <br /> a "reasonable foreseeable release", (currently estimated at <br /> $630,000) . This amount would be available to cover costs at any <br /> of the four following County sanitary landfills. <br /> SITE STATUS <br /> Harney Lane Sanitary Landfill Closed <br /> Corral Hollow Sanitary Landfill Active <br /> Foothill Sanitary Landfill Active <br /> North County Recycling Center and <br /> Sanitary Landfill Active <br /> It appears that several types of financial mechanisms may be <br /> acceptable to meet the financial assurance requirements. Further, <br /> it is not clear at this time which financial mechanisms will be <br /> acceptable to the California Regional Water Quality Control Board, <br /> Central Valley Region (hereafter CRWQCB) . Therefore, the County <br /> proposes to establish by June 30, 1992, a financial mechanism that <br /> meets the requirements of the CRWQCB. <br /> In developing a mechanism, the County will meet with the CRWQCB <br /> staff, and the California Integrated Waste Management Board <br /> (hereafter CIWMB) staff, if appropriate. <br /> The primary mechanism that the County wishes to pursue establishing <br /> is as follows: <br /> PLEDGE OF REY HUES <br /> Article 3.5 of Chapter 5, Division 7, Title 14 (hereafter Article <br /> 3.5) , of the California Code of Regulations requires landfill <br /> owners and operators to provide financial mechanisms for closure <br /> and postclosure maintenance activities for landfills. <br /> Section 18290 of Article 3.5 allows local governments to provide <br /> a "pledge of revenues" as a financial mechanism, to provide funds <br /> for postclosure maintenance of sanitary landfills. <br /> Therefore, the County proposes to develop and submit to the CRWQCB <br /> a similar financial mechanism that pledges revenues to meet the <br /> financial assurance requirements of Article 5. <br />
