(as per County prepared <br />site map) If for some reason there is a need to maintain <br />the test wells for a reasonably short period of time, then <br />the abandonment could be delayed until they actually become <br />an obstacle to Foothill's operations. . <br />Under threat of your legal action, Foothill will not <br />attempt to block the proposed testing as outlined in your <br />April 15, 1988 letter subject to the followings <br />1) That all work to be performed is authorized in <br />writing by the Lewis Family with specific designation. of <br />those who are Lessor's agents and employees for the purpse <br />of conduct of the.inspection. <br />2) That the names and addresses of all those going <br />upon the premises pursuant to the Lewis Family authorization <br />be given to Foothill's site manager at the time of entry or <br />prior to entry. <br />3) That the four test wells not exceed 100 ft. in <br />depth.' That the other twelve (12) holes to be drilled not <br />exceed approximately 3 ft. in depth and 3 inches in <br />diameter. <br />4) That every reasonable effort will be made to avoid <br />obstructing access to the shop, fuel, and acti-ve dumping <br />areas during the site operating hours. <br />5) That test holes not create a conduit for garbage <br />leachate or surface water to reach the underground water. <br />6) That test holes be located by proper survey and <br />properly backfilled and sealed in a timely fashion so as not <br />to interfere with Foothill's operations. <br />7) That the testing be monitored by a representative <br />of Foothill and the County with the right to take split <br />samples and conduct parallel tests. Foothill is willing to <br />reimburse for the extra cost associated with taking of the <br />split samples. <br />8) That an appropriate hold harmless and indemnifica- <br />tion of Foothill be obtained from those conducting the <br />testing with regard to resulting possible damages. <br />Foothill is quite concerned about possible contamina- <br />tion resulting from the proposed testing .operation and <br />expects that the Lewis Family, its agents and employees will <br />adhere to the highest standards and best procedures to <br />minimize the risk. The test wells and sealing thereof could <br />present a problem for many years to come. Foothill would of <br />
