Requirements for Producers of Infectious Waste. <br />(a) All the requirements of this chapter shall apply to any producer of more <br />than 100 kilograms of infectious waste per month. <br />(b) All the requirements of this chapter, without regard to the quantity of <br />infectious waste produced per month, shall apply to any licensed health care <br />facility which is a p ' care clinic, surgical clinic, or chronic dialysis clinic, <br />as defined in Chapter L - Division 2, Health and Safe Code; general acute care <br />h ital, acute psychiatric hospital, skilled nursing acility, intermediate care <br />facility, or intermediate care facility for the developmentally disabled, as de- <br />fined in Chapter 2, Division 2, Health and Safety Code. <br />(c The requirements of Sections (g), 66845(b) and 66845(c) of this <br />article shall apply to any producer of infectious waste. <br />NOTE: Authority cited: Sections 206, 25150 and 25157.3, Health and Safety Code. Refer- <br />ence: Sections 1204, 1250, 25118 and 25143, liealth and Safety Code. <br />HISTORY: <br />1. New Article 13 (Sections 66635-66865, not consecutive) filed 12.30-83 as an emer- <br />gency; effective upon Filing (Register 84, No. 3). A Certificate of Compliance must be <br />transmitted to OAL within 120 days or emergency language will be repealed on 4-29-84. <br />2. Certificate of Compliance transmitted to OAL 4-30-84 and withdrawn 5-34-84 (Regis- <br />ter 84, No. 24) . <br />3. New Article 13 (Sections 66&15-66865, not consecutive) filed 5-30-84 as an emer- <br />gency; effective upon filing (Register 84, No. 24). A Certificate of Compliance must be <br />transmitted to OAL within 120 days or emergency language will be repealed on 9-2744. <br />4. Certificate of Compliance transmitted to OAL 9-26.84 and filed 10-16-84 (Register <br />84, No. 41). <br />5. Amendment of subsections (a) and (b) filed 10.16-84; effective thirtieth day thereaf- <br />ter (Register 84, No. 41) . <br />66840. Storage and Containment of Infectious Waste. <br />(a) The provisions of this section, insofar as infectious wastes are concerned, <br />supersede the provisions of Section 66535 of this chapter pertaining to the <br />storage of hazardous waste. <br />(b) Containment of infectious waste shall be in a manner and location which <br />affords protection from animals, rain and wind and does not provide a breeding <br />place or a food source for insects or rodents. <br />(c) infectious waste shall be segregated from other waste at the point of <br />origin in the producingfacility. <br />Unless approved by the local health officer, or the Department pursuant <br />to Section 66310, infectious waste shall not be contained at a waste producing <br />facility for more than four days above a temperature of 0°C (32° F) . Contain- <br />ment of infectious waste at the waste producing facility is permitted at or below <br />a temperature of VC (32' F) for a period of not more than 90 days before <br />disposal without specific approval. Infectious waste shall not be stored for more <br />than days at the wasteproducing facility or more than 96 hours off the site <br />of the waste producing facility without the written approval of the Department <br />or without a hazardous waste facility permit. <br />(e) Containment of infectious waste shall be separate from other wastes. <br />Enclosures or containers used for the containment of infectious waste shall be <br />so secured as to deny access to unauthorized persons and shall be marked with <br />prominent warningg signs on, or adjacent to, the exterior of entry doors, gates <br />or lids. Wordin of warning signs shall be in english, "CAUTION --INFEC- <br />TIOUS WM STORAGE AREA --UNAUTHORIZED PERSONS KEEP <br />OUT", and Spanish, "CUIDADO--ZONA DE RESIDUOS INFECTADOS-- <br />PROHIBIDA LA ENTRADA A PERSONAS NO AUTORIZADAS". Warning <br />signs shall be readily legible during daylight from a distance of at least 25 feet. <br />
