1� <br />Em <br />M <br />G2, C-3, D-1 and D-2 in accordance with the payment schedule listed Exhibit C-1, delivered to the <br />Solano County District Attorney's Office, 675 Texas Street, Suite 4500, Fairfield, CA 94533, to the <br />311 attention of DDA Diane Newman, for distribution pursuant to the teens of this Final Judgment. <br />a. Civil Penalties <br />Defendants shall pay nine hundred thousand dollars ($900,000.00) as civil penalties to <br />the entities identified in, and in accordance with, the terms of Exhibits C-1, C-2 and C-3, attached <br />hereto and made a part of this Final Judgment by this reference. <br />b. Reimbursement of Costs of Investigation and Enforcement. <br />Within five (5) business days after entry of this Final Judgment, Defendants shall pay <br />10 two hundred thousand dollars ($200,000.00) for reimbursement of costs of investigation, attorney's <br />11 fees, and other costs of enforcement to the entities identified in, and in accordance with the terms of, <br />12 Exhibits D-1 and D-2, attached and made a part of this Final Judgment by this reference. <br />13 ENFORCEMENT OF FINAL JUDGMENT <br />14 8. The People may move this Court for additional relief for violation of any provision <br />i5 of this Final Judgment, including but not limited to, contempt, additional injunctive remedies, or <br />16 additional penalties_ Nothing in this Final Judgment shall limit any rights of the People to seek any <br />17 other relief or remedies provided by law. <br />18 9. The Court shall retain continuing jurisdiction to enforce the injunctive terms of this <br />19 Final Judgment and to address any other matters arising out of or relating to the injunctive <br />provisions this Final Judgment. <br />2111 MATTERS RESOLVED BY THIS FINAL JUDGMENT <br />10. This Final Judgment is a final and binding resolution and settlement of the claims, <br />violations and causes of action occurring at the defendants' facilities listed in Exhibit A and alleged <br />2411 by the People in the Complaint in this matter, through the date of filing of this Final Judgment which <br />2511 shall be known as "Covered Matters." Any claim, violation, or cause of action that is not a Covered <br />Matter is a "Reserved Claim." <br />11. Reserved Claims include, without limitation: any violation that occurs after the filing <br />28 of this Final Judgment; any claim, violation, or cause of action against independent contractors or <br />16 <br />Hassan & Sons, Inc., et al. 1Proposedl Final Judgment and Permanent Injunction <br />
