PC: 7-17-75 -8- <br /> Powers, cont. <br /> subdivision should not be permitted here until subdivision services become available. <br /> Staff recommended denial with the finding that the proposal is premature in that <br /> services required for a subdivision are not available. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Chance Wong, engineer for this application, was present. He said he <br /> took over the engineering of this subdivision four months ago; the subdivision was <br /> first started about one year ago. The parcel contains 28 acres and Mr. Powers has <br /> his home on it. The proposal is to create a nice atmosphere for this subdivision. <br /> This revised subdivision proposal was reduced from 43 lots to 31 lots and each one <br /> to contain 30,000 sq. ft. He compared this subdivision to Morada Estates. This <br /> area is committed to residential development. He noted the mobilehome parks and <br /> the density of such development. <br /> Joseph Powers, 4800 Cherokee Rd. , was present and noted the circulation pattern and <br /> residential development in the area. He said that even though this is supposed to be <br /> an agricultural area there is a great amount of development here. He said he is a <br /> native of this area and has his home in this community. <br /> OPPONENTS: Phil Dykes, Cherryland Ave. , was present and objected to the proposal; there <br /> will be problems from access, drainage and sand in the water wells. Agricultural <br /> spraying is not compatible with the subdivision. This proposal will set a precedent <br /> for further division of the property in this neighborhood. <br /> Weber G. Fisher, 4728 E. Cherryland, was present and said he is unalterably opposed <br /> to the subdivision. He said that the walnut orchard in which the subdivision is to <br /> be located was neglected in anticipation of this development. Subdivision facilities <br /> are not available. This proposal will increase taxes in the area, will create problems <br /> with roads, traffic, dust and population density. He did not have an opportunity to <br /> review the 14 conditions recommended by the Development Committee. He requested a <br /> continuance. Mr. Fisher said his home is on a one acre parcel which he purchased in <br /> 1968 - the home was existing at that time. His home is served by a well and a septic <br /> tank and he has had to drill another well. Mr. Fisher was of the view that this area <br /> will gradually develop toward residential, however, the facilities are not presently <br /> available. <br /> Joe Sabatini, 5266 Cherokee Road, was present and said he owns 25 acres of cherries <br /> in close proximity to subject property. He felt that residents of the subdivision <br /> would take cherries and damage trees; that the subdivision would hamper his farming <br /> operation. He has had problems with the water table. <br /> Roxanna Dykes, 3603 Cherryland, was concerned over increased school enrollment from <br /> the subdivision; the school is already overcrowded. She was also concerned that the <br /> applicant may not abide by restrictions. Another developer (Italian Athletic Club ) <br /> did not meet a condition requiring a fence, <br /> Sharon Rath, 4035 Cherryland, stated the notification of this hearing was not adequate. <br /> Her property is five lots from subject property; she has one acre for her home and owns <br /> cows and horses; her land use would not be compatible with the subdivision. <br /> Mr. Fisher emphasized that drainage is a severe problem in this area, <br /> REBUTTAL: Mr, Wong said that this subdivision proposes only 31 units for this 28 acre <br /> parcel; the lots will be larger than city lots; they do not intend to create drainage <br />
