the faithful performance of Developer in a sum not to exceed <br /> $311 ,000 . 00 . <br /> i <br /> (b) Complete a tennis pro shop, locker rooms , and <br /> dressing rooms in accordance with the plan attached hereto, <br /> marked Exhibit "C" . Developer agrees to impound, in an in- <br /> terest bearing trust account with Lindsay P. Marshall, At- <br /> torney at Law, the sum of $5 ,000 . 00 from each residential <br /> lot sale until a sum of $50 , 000 . 00 has been impounded, to <br /> secure faithful completion of said improvements. <br /> (c) Complete three (3) new lighted and fenced <br /> tennis courts directly to the North of the existing courts , <br /> in accordance with the plan attached hereto, marked Exhibit <br /> "D" . Developer agrees to impound, in an interest bearing <br /> trust account with Lindsay P. Marshall , Attorney at Law, the <br /> sum of $5 ,000. 00 from each residential lot sale until a sum <br /> r of $50, 000. 00 has been impounded, to secure faithful comple- <br /> tion of said improvements. <br /> (d) Complete the subdivision of the approximate <br /> twenty-seven (27) acres described in Exhibit "A" in accord- <br /> ance with the conditionally approved subdivision map attached <br /> hereto, marked Exhibit "E" ; subject to the conditions set <br /> forth in Resolution No. R-77-2236 , adopted by the Board of <br /> Supervisors of the County of San Joaquin on November 17, <br /> 1977 , which Resolution is incorporated herein by reference. <br /> (e) Pay to Club the sum of $240 , 000. 00 , cash , as <br /> follows : <br /> (1) $100 ,000. 00 upon approval by the County <br /> of San Joaquin of a final subdivision map of the twenty- <br /> seven (27) , more or less, acres. <br /> (2) Pay to Club the sum of $140 , 000. 00 within <br /> forty-five (45) days of completion of the subdivision. Com- <br /> pletion of the subdivision is defined as the time when <br /> streets , curbs, gutters , utility services, storm drainage, <br /> and the county service area required under said Resolution <br /> No. R-77-2236 of the San Joaquin County Board of Supervisors, <br /> have all been approved and accepted by the County of San <br /> Joaquin. <br /> (f) Complete landscaping between the clubhouse, <br /> tennis courts , and subdivision. <br /> (g) Developer agrees to insert in its recorded <br /> covenants , conditions , and restrictions covering this <br /> -2- <br />
