PC: 9-10-E7 <br />ZR-87-34/SU-86-12- <br />CONDITIONS <br />R-87-34/SU-86-12_ <br />CONDITIONS OF APPROVAL <br />The following conditions of approval, unless otherwise noted, <br />shall be met prior to the filing of the final map. <br />1. Planning Division: <br />a. The Public Report filed with the State Department of Real <br />Estate should indicate the current and possible increased <br />activity at the Tracy Municipal Airport and the related <br />noise potential from aircraft in the project area. <br />b. The Public Report filed with the State Department of Real <br />Estate should reference the County's right -to -farm ordi- <br />nance. <br />c. A noise reduction wall shall be constructed along the <br />south property line of the subdivision fronting on the <br />Western Pacific Railroad line. The noise barrier shall <br />reduce the noise level at the property line to 65 deci- <br />bels, Ldn (day -night average level). <br />d. Pursuant to Section 66474.9 of the Subdivision Map Act, <br />the subdivider shall defend, indemnify, and hold harmless <br />the local agency or its agents, officers, and employees <br />from any claim, action, or proceeding against the local <br />agency or its agents, officers, or employees to attack, <br />set aside, void, or annul an approval of the local agency, <br />advisory agency, appeal board, or legislative body con- <br />cerning a subdivision, which action is brought within the <br />time provided for in Section 66499.37 of the Subdivision <br />Map Act. <br />2. Department of Public Works: <br />a. Fairoaks Road shall be widened on the subdivided side in <br />conformance with the standards for a 50 -foot right-of-way <br />farm or estate road. <br />b. A master circulation plan shall be prepared for the area <br />approved by GP-86-1/ZR-67-34. The interior street layout <br />shall be incorporated into the master circulation plan and <br />constructed to County standards for 50 -foot right-of-way <br />farm or estate roads. <br />c. A master drainage plan shall be prepared for the area <br />approved by GP-86-1/ZR-87-34. A community drainage pond <br />shall be constructed in conformance with the master <br />-16- <br />
