EXHIBIT "A" <br />Subdivision <br />October 20, <br />Public Water Requirements <br />No. SU -86-12 <br />1987 <br />1. The developer shall pay a fee which represents a proportionate <br />share of the Master Planned Water Facilities to be used for <br />the construction of the facilities and related engineering <br />(which may include the preparation of a Master Plan for the <br />affected area). <br />2. The fee for the construction of the Master Planned Facilities <br />shall be $2,800 per lot, and will be adjusted annually follow- <br />ing the execution of the Agreement, in accordance with the <br />Engineering News Record Cost Index. <br />3. Funds collected for the Master Planned Water Facilities shall <br />be placed in an interest-bearing trust account with the <br />County of San Joaquin. <br />4. Master Planned Water Facilities fees shall be paid for at the <br />time of issuance of a Building Permit. <br />5. The Agreement shall provide that the funds will be collected <br />for a maximum of 15 years from the date the Agreement is <br />executed. If the public water system is not constructed <br />within 15 years from the date of Agreement execution, the <br />funds, including interest, will be proportionately returned <br />to the owner of the property at that time. <br />6. In the event that the funds collected are insufficient to <br />construct the Master Planned Water Facilities, the owner <br />of the property will at that time be obligated to pay his <br />proportionate share of the difference. In the event surplus <br />funds are available after construction of the Master <br />Planned Facilities, the funds with interest shall be returned <br />proportionately to the owners of the property at that time; <br />or, at the County's option, placed in the operating account <br />of the County Service Area for the operation and maintenance <br />of the system. <br />7. Individual private wells, if developed for each lot on an <br />interim basis, shall be constructed in accordance with <br />Local Health District requirements as follows; <br />
