Planning Commission <br /> April 2 , 1987 <br /> Page 2 <br /> I am providing this information because my previous <br /> discussions with the applicant' s attorney lead me to believe that <br /> there may be some attempt to discuss other time periods during <br /> the public hearing . In reviewing all applicable laws and regula- <br /> tions regarding this matter , it is my opinion that the only cri- <br /> tical deadline to be considered at tonight ' s hearing is this one <br /> year statutory period. Therefore, it is my recommendation that <br /> you proceed by acting on the appeal of the EIR requirement. As <br /> you know, unless there is a change in the project which would <br /> either mitigate or delete any potential significant impacts <br /> noted, an EIR must be required. Once you have made a deter- <br /> mination on this issue, it would then be appropriate to proceed <br /> with your action on the approval or disapproval of the sub- <br /> division applicant . As indicated in the staff report, the ten- <br /> tative map application may be denied without prejudice so as to <br /> allow the applicant to proceed with the project in the future by <br /> starting at the point where he left off . <br /> Very truly yours , <br /> JOHN F.
