Planning Commission
April 2 , 1987
Page 2
I am providing this information because my previous
discussions with the applicant' s attorney lead me to believe that
there may be some attempt to discuss other time periods during
the public hearing . In reviewing all applicable laws and regula-
tions regarding this matter , it is my opinion that the only cri-
tical deadline to be considered at tonight ' s hearing is this one
year statutory period. Therefore, it is my recommendation that
you proceed by acting on the appeal of the EIR requirement. As
you know, unless there is a change in the project which would
either mitigate or delete any potential significant impacts
noted, an EIR must be required. Once you have made a deter-
mination on this issue, it would then be appropriate to proceed
with your action on the approval or disapproval of the sub-
division applicant . As indicated in the staff report, the ten-
tative map application may be denied without prejudice so as to
allow the applicant to proceed with the project in the future by
starting at the point where he left off .
Very truly yours ,
JOHN F. CHEADLE
County Counsel
By
SANDRA MICHAEL AFFONS
Deputy County Counsel
8SMA/WOODSON
