To Planning Commission Item No. 1 <br /> From: Chet Davisson <br /> Sub : SU-86-10 <br /> Date : 3-19-87 <br /> Page: - 2 - <br /> However, the applicants' attorney, Steve Herum, recently advised <br /> staff that no redesign will be forthcoming and that the appli- <br /> cants wish to have their appeal on the EIR requirement heard at <br /> this time . <br /> However, since a year has elapsed since the application was <br /> determined complete and no significant progress has been made, <br /> staff recommends that action be taken tonight as detailed above . <br /> In addition to denying the appeal of the EIR requirement , a <br /> denial "without prejudice" action for SU-86-10 is also recom- <br /> mended. This action will close the current project file but <br /> allow the applicant to refile at such time as he is ready to <br /> proceed diligently to completion. Processing of the new applica- <br /> tion could pick up essentially at the point that this file ends, <br /> saving duplication of completed work and analysis . <br /> Also pertinent to this appeal is the status of the Lodi (Lind' s ) <br /> Airport . The Commission recently delayed inclusion of this air- <br /> port in the Planning Title ' s AP combining zone. The Commission <br /> asked for more information on the operation of this airport <br /> before taking action to include it in the AP chapter . This data <br /> has been provided as an "informational" report for consideration <br /> at tonight ' s hearing. This information indicates that the <br /> crosswind runway is necessary for the airport ' s continued opera- <br /> tion (refer to the report for specific information) . Staff ' s <br /> position regarding the potential air safety concerns remains <br /> regardless of whether or not this airport has an adopted AP com- <br /> bining zone . This designation serves as an extra flag to bring <br /> attention to possible safety restrictions adopted in the Council <br /> of Government ' s (COG) Airport Land Use Plan. The Lodi (Lind' s) <br /> Airport and environs continue to be subject to the provisions of <br /> this plan whether or not the airport combining zone is adopted. <br /> Further, COG has informed the Planning Division that residential <br /> construction on all lots within the "Inner Approach/ Climb-out" <br /> zone is prohibited, and further, COG has recommended denial of <br /> the subdivision because of the need for air/space protection and <br /> of the subdivision' s proximity to the airport in general . <br /> r <br /> CD/DD/blm <br />
