SU-86-10 OF WOODSON <br /> ESTATES (C/O BAUMBACH & PIAZZA) FOR AN APPEAL OF <br /> STAFF ' S DETERMINATION TO REQUIRE A "SUBSEQUENT" <br /> ENVIRONMENTAL IMPACT REPORT FOR AN 81-LOT RURAL <br /> RESIDENTIAL SUBDIVISION. LOCATED ON THE NORTHWEST <br /> QUADRANT OF STATE ROUTE 99 AND JAHANT ROAD, <br /> COLLIERVILLE , NORTH OF LODI <br /> --------------------------------------------------------------- <br /> RECOMMENDATION : <br /> 1 . Deny the appeal and uphold the requirement for the prepara- <br /> tion of a "subsequent" Environmental Impact Report (EIR) , <br /> based on Section 15O64 (a) ( 1 ) of the California Environmental <br /> Quality Act (CEQA) Guidelines and as further described in the <br /> "Response to Appeal" section of the attached staff report . <br /> 2 . Further , deny "without prejudice" Major Subdivision <br /> Application No . SU-86-10, based on expiration of the one-year <br /> maximum processing time permitted by Government Code Section <br /> 15108 . <br /> BACKGROUND : <br /> This item was continued from the Planning Commission hearing of <br /> December 4 , 1986, at the request of the applicants . The appli- <br /> cants indicated at the time that they were considering possibly <br /> redesigning the project as a Planned Unit Development to avoid a <br /> conflict with the airport zone proposed for Lodi (Lind ' s ) Airport <br /> to the south. <br /> At the time of continuance, it was noted that this would be the <br /> last continuance possible before the one-year time limit expired. <br /> Some action must be taken at this time to prevent an "automatic <br /> approval . " <br /> Staff assumed that the developer was working on design alter- <br /> natives during this time period - specifically, a design solution <br /> addressing identified air safety and toxic waste concerns. <br />
