Metal fines generated from brake lathe shaving are being recycled as scrap metal without first determining particle size or <br />hazardous properties. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately <br />stop recycling metal fines, make a hazardous waste determination for the brake lathe shaving, and manage it according the <br />Title 22 hazardous waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is <br />determined to be a hazardous waste. Submit a statement and supporting documentation explaining how this waste was <br />managed by July 11, 1011. <br />7. Failed to determine if a waste is a hazardous waste: <br />At time of inspection: <br />Lead acid batteries are sprayed with "Technician Grade Battery Cleaner with Acid Indicator". According to Debbie, the liquid <br />which may include battery acid is wiped up with a towel and thrown away, without first making a hazardous waste <br />determination. <br />Immediately make a hazardous waste determination pursuant to Title 22 hazardous waste regulations and handle <br />accordingly or handle as hazardous waste. Within 30 days provide written documentation describing how these waste <br />streams were handled. <br />18 & 20. 1-15 gallon container of brake fluid was seen labeled with the words hazardous waste and the contents. All <br />hazardous waste containers shall be marked with the following information: <br />1. the words "Hazardous Waste" <br />2. name and address of generator <br />3. hazardous properties <br />4. physical state <br />5. composition (contents) <br />6. accumulation start date <br />Immediately label these containers and ensure that all containers are marked with all the required information. Since it <br />cannot be determined how long the brake fluid has been on site, immediately contact a licensed hazardous waste hauler to <br />dispose of this waste under manifest and submit a copy of the manifest to the EHD by July 11, 2011. <br />23. 1-55 gallon drum of drained used oil filters were seen open without a label. Used oil filters must be stored in a closed, <br />rainproof container, labeled as "drained used oil filters," and marked with an accumulation start date. Immediately close and <br />properly label and ensure that all used oil filters are managed in this way. <br />32. Failed to comply with new HW tank system assessment requirements: <br />At time of inspection: <br />Facility did not have tank assessment for the hazardous waste tanks, used oil and waste antifreeze on site pursuant to <br />66265.192 CCR. Immediately have a tank assessment prepared for hazardous waste tank(s), pursuant to 66265.192 CCR. <br />Within 30 days submit a copy to this office for review.
