T22, CCR 66273.35(b) Unable to demonstrate the length of time the universal <br />waste has been accumulated from the date it became a waste. A universal waste <br />handler shall be able to demonstrate the length of time that the universal waste has <br />been accumulated from the date it became a waste or was received. The universal <br />waste handler may make this demonstration by: <br />(1) Placing the universal waste in a container and marking or labeling the container with <br />the earliest date that any universal waste in the container became a waste or was <br />received; <br />(2) Marking or labeling the individual item of universal waste (e.g., each battery or <br />thermostat) with the date it became a waste or was received; <br />(3) Maintaining an inventory system onsite that identifies the date the universal waste <br />being accumulated became a waste or was received; <br />(4) Maintaining an inventory system onsite that identifies the earliest date that any <br />universal waste in a group of items of universal waste or a group of containers of <br />universal waste became a waste or was received; <br />(5) Placing the universal waste in a specific accumulation area and marking or labeling <br />the area to identify the earliest date that any universal waste in the area became a <br />waste or was received; or <br />(6) Any other method which clearly demonstrates the length of time that the universal <br />waste has been accumulated from the date it became a waste or was received. <br />4 It could not be determined how long eight used fluorescent lamps found during <br />the July 26, 2010, hazardous waste inspection were stored. <br />Underground storage tank violations <br />HSC 25284 No permit to operate. <br />(a)(1) Except as provided in subdivision (c), no person may own or operate an <br />underground storage tank unless a permit for its operation has been issued by the local <br />agency to the owner or operator of the tank, or a unified program facility permit has been <br />issued by the local agency to the owner or operator of the unified program facility on <br />which the tank is located. <br />4 This facility did not have a valid annual permit to operate a UST system in 2013. <br />HSC 25284.2 Annual spill containment testing not performed. The owner or <br />operator of an underground storage tank with a spill containment structure designed to <br />prevent a release in the event of a spill or overfill while a hazardous substance is being <br />placed in the tank shall annually test the spill containment structure to demonstrate that <br />it is capable of containing the substance until it is detected and cleaned up. <br />4 Spill container testing was performed on September 28, 2012, two months late. <br />HSC 25291(b) UST monitoring system incapable of detecting a leak from primary <br />containment into secondary containment. The underground tank system shall be <br />designed and constructed with a monitoring system capable of detecting the entry of the <br />hazardous substance stored in the primary containment into the secondary containment. <br />4 The diesel tank annular sensor failed when tested on July 23, 2008. <br />4 The monitoring panel's audio and visual alarms were not working properly on <br />July 23, 2008. <br />4 The diesel tank annular sensor failed to clear when tested on September 28, <br />2012. <br />14 <br />
